9th Circuit reverses dismissal of NEPA case against Air Force

The group accusing the U.S. Air Force of failing to comply with federal environmental law requirements regarding open burning/detonation activities has succeeded at the 9th U.S. Circuit Court of Appeals, which determined that the group does have standing to sue and reversed a lower court's dismissal of the case. 

Prutehi Litekyan: Save Ritidian, now known as Prutehi Guåhan, filed suit against the U.S. Air Force and the Department of Defense at the District Court of Guam in January 2022, alleging that the Air Force failed to comply with the National Environmental Policy Act, or NEPA, by failing to evaluate the cultural and environmental impacts of open burning/detonation for hazardous waste disposal, or considering alternative ways to dispose of such waste. The group is represented by Earthjustice, an environmental law organization.
